End User Licence Agreement
Governing all use of the WhereZit software platform

1. Grant of Licence
Subject to your acceptance of and continued compliance with this EULA and the applicable WhereZit Player Terms and Conditions or NPO Client Terms and Conditions, WhereZit grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the WhereZit platform at wherezit.co.za solely for the following permitted purposes:
- Players: to register an account, browse competitions and submit entries as a participating player
- NPO client administrators: to create and manage competitions on behalf of your registered organisation
- Judges: to access the judge portal and submit coordinate judgments for competitions to which you have been appointed
This licence does not grant you any ownership rights in the platform or any of its content.
2. Restrictions on Use
You may not, directly or indirectly:
- Copy, modify, adapt or create derivative works based on the platform or any part of it
- Reverse engineer, decompile or attempt to derive the source code of the platform
- Use automated tools, bots, scrapers or any non-human means to access or interact with the platform
- Attempt to gain unauthorised access to any part of the platform, its servers, databases or networks
- Use the platform in any manner that could damage, disable or impair WhereZit’s systems or infrastructure
- Resell, sublicence or transfer your access rights to any third party
- Attempt to view or reconstruct other users’ entry coordinates during an active competition
- Transmit malware, viruses or harmful code through the platform
- Use the platform for any unlawful purpose under South African law
3. Platform Availability and Updates
WhereZit endeavours to maintain platform availability but does not guarantee uninterrupted or error-free access. WhereZit may update, modify or discontinue any feature at any time with or without notice. Updates may be applied automatically. Continued use after any update constitutes acceptance. WhereZit is not liable for any loss caused by platform unavailability or technical failure.
4. Intellectual Property
The platform and all its contents are the exclusive property of WhereZit or its licensors, protected by South African intellectual property law including the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993. Nothing in this EULA transfers any intellectual property rights to you.
5. User Content
You retain ownership of content you submit to the platform. By submitting content you grant WhereZit a worldwide royalty-free licence to use, store and process it solely to the extent necessary to operate the platform. You are responsible for ensuring your content does not infringe third party rights. WhereZit may remove any content that violates these terms.
6. Disclaimer of Warranties
The platform is provided on an ‘as is’ and ‘as available’ basis. To the maximum extent permitted by South African law, WhereZit disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
7. Limitation of Liability
WhereZit’s liability under this EULA is limited to the total entry fees paid by the user in the 30 days preceding the event giving rise to the claim. WhereZit is not liable for indirect, consequential, incidental or special damages of any kind.
8. Termination
This licence terminates automatically upon account closure or suspension for any reason, or upon breach of this EULA or any other WhereZit agreement. Upon termination you must immediately cease all access to and use of the platform.
9. Governing Law
This EULA is governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the courts of Pretoria.
